As part of the implementation of the government's anti-fraud policy and with the aim of strengthening the management of the use of subscriber numbers and the KYC mechanism, on April 26, 2024, NCC promulgated “Regulations Governing the Use of the Subscriber Numbers on Telecommunications Enterprises” (hereinafter referred to as Regulations).
The NCC points out that these Regulations are for telecommunications enterprises that have been assigned subscriber numbers and those that are engaged in the wholesale and resale of such numbers (e.g., Mobile Virtual Network Operators, "MVNOs"). Enterprises are required to fulfill the obligations of Know Your Customer (KYC), risk management and internal control verification on various operational and technical aspects, and are specifically instructed to strengthen the management of applications for subscriber numbers by corporate customers. In addition, considering the characteristic of quick transactions of online retailing platforms, the relevant operators are also requested to cooperate to help check that the selling information of products related to subscriber numbers complies with the provisions of these Regulations, so that consumers can obtain the necessary information when purchasing the relevant products.
The NCC also emphasized that these Regulations are in line with the " Preventing fraud" strategy of the "Next-Generation Anti-fraud Strategy Guidelines, version 1.5" promulgated by the Executive Yuan to prevent subscriber numbers from being used as fraudulent tools, to strengthen the management of the use of telecommunications enterprise subscriber numbers, and to implement the KYC mechanism, so as to ensure that number resources are used legally and in an orderly manner, with a view to fulfilling the legislative purpose of preventing fraud and maintaining social stability.
