Regulations for Qualifying and Governing of Senior Telecommunications Engineer and Telecommunications Engineer (Sep. 13, 2002)

Article 1

This Regulation is promulgated pursuant to Paragraph 2 of Article 43 of the Telecommunications Act (hereinafter this "Act").

Article 2

The competent authority for this Regulation is the Ministry of Transportation and Communications (hereinafter referred to as "MOTC"), and the matters as stated in this regulation may be delegated to the Directorate General of Telecommunications (hereinafter referred to as "DGT").

Article 3

An Senior Telecommunications Engineer mentioned in this Regulation means one who is responsible for and supervises the construction, maintenance and operations of telecommunications enterprises' telecommunications facilities.

A Telecommunications Engineer mentioned in this Regulation means one who is responsible for the construction and supervision of telecommunications terminal equipment connected to the telecommunications line facilities and equipment of a Type I telecommunications enterprise.

Article 4

Senior telecommunications engineer shall have one of the following qualifications:

(1)One who was engaged in the work of telecommunications switching, telecommunications transmission, data communications, telecommunications electric power or telecommunications circuits over one year and can provide certification for such experience. In addition, one of the following qualifications should also be possessed:

(i)Passing the Senior National Examination or Special Examination which is equivalent to the Senior National Examination in the subject of automatic control engineering, electric power engineering, control engineering, electronics engineering, telecommunications engineering, information engineering, information processing, information science; passing the Special Professional and Technical Personnel Senior National Examination or Qualification Examination for electrical engineering, electronics engineering technician, and information technician or passing the first-class, second-class or third-class Special Examination for telecommunications senior technician.

(ii)Passing the communications business personnel upgrade examination for telecommunications senior technician during the period working for the telecommunications institutions.

(iii)Passing the first-class line circuit operator examination of Special Examination for telephone operator.

(iv)Passing the Senior National Examination or Special Examination which is equivalent to the Senior National Examination in the areas not listed in item (i) and also is qualified based on the senior technician position according to the communications business personnel qualification regulations during the period working for the telecommunications institution.

(2)One who was engaged in the work of telecommunications switching, telecommunications transmission, data communications, telecommunications electric power or telecommunications line circuits over three years and can provide certification has one of the following qualifications:

(i)Passing the subject of electric power engineering, electronic engineering, information engineering or information processing in General National Examination or the forth-class Special Examination equivalent to General National Examination, or passing the forth-class Special Examination for telecommunications technician.

(ii)Passing the communications business personnel upgrade examination for telecommunications technician during the period working for the telecommunications institution..

(iii)Passing the second-class line circuit operator or switchboard operator examination of Special Examination for telephone operator.

(iv)Obtaining certificate of second-class telecommunications technology technician issued by the Labor Council of the Executive Yuan.

(v)Passing the General National Examination or Special Examination which is equivalent to the General National Examination in the areas not listed in item (i)of this Subparagraph and also is qualified based on the technician position according to the communications business personnel qualification regulations during the period working for the telecommunications institution.

(3)One who obtained the graduation certificate from the telecommunications engineering, electric power engineering, electronic engineering, control engineering, information engineering or information processing, information, electrical engineering or other related department in public university, private university which legally registered for the status claimed, college or foreign university that recognized by Ministry of Education, and was engaged in the work of telecommunications switching, telecommunications transmission, data communications, telecommunications electric power or telecommunications circuits over two years and can provide certification.

(4)One who served as the telecommunications engineer of Subparagraph 3 to 8 of Article 5 of this Regulation and then was engaged in the telecommunications switching, telecommunications transmission, data communications, telecommunications electric power or telecommunications line circuits work over five years and can provide certification.

(5)One who served as the telecommunications engineer of Subparagraph 9 to10 of Article 5 of this Regulation and then was engaged in the telecommunications switching, telecommunications transmission, data communications, telecommunications electric power or telecommunications line circuits work over eight years and can provide certification.

Article 5

Telecommunications engineer shall have one of the following qualifications:

(1)Passing the Senior National Examination or Special Examination which is equivalent to the Senior National Examination in the subject of automatic control engineering, electric power engineering, control engineering, electronics engineering, telecommunications engineering, information engineering, information processing, information science; passing the Special Professional and Technical Personnel Senior National Examination or Qualification Examination for electrical engineering, electronics engineering technician, and information technician.

(2)Passing the subject of electric power engineering, electronic engineering, information engineering or information processing in General National Examination or the forth-class Special Examination equivalent to General National Examination.

(3)Passing the level of (or above) the Special Examination for telecommunications assistant technician.

(4)Passing the Special Examination for telephone operator.

(5)Passing level of (or above) the communications business personnel upgrade examination for telecommunications assistant technician during working for the telecommunications institution.

(6)Obtaining certificate of the third-class or higher telecommunications technology technician issued by the Labor Council of the Executive Yuan.

(7)Obtaining the graduation certificate from the electronic engineering, electronic engineering, telecommunications engineering, information, information engineering, information processing, electric power engineering, control engineering or other related department in or above the public or private junior college which legally registered for the status claimed or in or over the foreign junior college that recognized by Ministry of Education or obtained the junior college or above descriminational qualified certificate according to the self learning and examination guidelines issued by the Ministry of Education.

(8)Passing the General National Examination or Special Examination which is equivalent to the General National Examination in the areas not listed in technical areas of Subparagraph 1,2 of this Article and also is qualified based on the technician position according to the communications business personnel qualification regulations during the period working for the telecommunications institution.

(9)One who served as the telecommunications engineer and then was engaged in the telecommunications switching, telecommunications transmission, data communications, telecommunications electric power or telecommunications circuits work over three years and can provide certification.

(10)One who obtained the graduation certificate from the electrical engineering, electronic engineering, electronic automatic control, control, electrical signal, electronic communications, information and other related department in public, private domestic advance industrial (Industrial and commercial) vocational school or foreign vocational school that recognized by Ministry of Education, or obtained the vocational school certificate according to the self learning and examination guidelines issued by the Ministry of Education, and was engaged in the work of telecommunications switching, telecommunications transmission, data communications, telecommunications electric power or telecommunications circuits over three years and can provide certification.

Article 6

Telecommunications enterprise shall review and employ qualified senior telecommunications engineers, prescribed by this regulation, to be responsible for the supervision of telecommunications equipment construction, maintenance and operations.

Enterprises who are connecting the telecommunications terminal equipment to the type 1 telecommunications line facilitate and equipment shall review and employ qualified telecommunication engineers, prescribed by this regulation, to be responsible for the construction or supervision of telecommunications terminal equipment connected to the type 1 telecommunications line facilitate and equipment installation.

Within sixty days, company shall submit the resumes (based on appendix 1 or 3 format) recruited senior telecommunications engineers or telecommunications engineers to the DGT for review. Future changes in employment shall also report to the DGT.

Senior telecommunications engineers, telecommunications engineers qualification review and employment resume, telecommunications engineers qualification review and employment resume, senior telecommunications personnel and telecommunications engineer personnel qualification and report process flow chart is described in the Appendix (telecommunications business is listed in Appendix 1 and 2, Non-telecommunications business is listed in Appendix 3 and 4.

Article 7

Enterprises shall not employ persons who serve as senior telecommunications engineer or telecommunications engineer if having one of the following circumstances:

(1)One was announced interdiction and the interdiction is still not revoked.

(2)One has the mental disorder proved by a qualified doctor.

(3)One (who obtained the qualification through the examination process) lost the qualification based on the cancellation of qualification regulations specified in the Examination Regulations.

(4)After reviewed by the DGT, qualification of the senior telecommunications engineer or the telecommunications engineer listed in the resumes were not compliant with Article 4 or 5 of this regulation.

Article 8

One who obtained the senior telecommunications engineer or telecommunication engineer qualification license issued by the MOTC, its qualification shall remain effective.

Article 9

This Regulation shall come into effect upon the date of promulgation
