Essential operations in promoting the development of cable broadcasting(Oct.29.2009)

The amended Essential operations were promulgated by NCC, on Oct. 29, 2009, Ref. the Order Tong Chuan Ying No. 09841071590

  1. In order to effectively use the Cable Radio and Television Development Fund (hereinafter as “this Fund) in promoting the development of cable broadcasting universal service, these Essential operations are promulgated.
  2. The subsidies in cable radio and television universal service according to these essential directions are limited to the areas where the cable radio and television service of operators designated by NCC (hereinafter as “NCC”) has not yet reached ( as appendix 1,)and other cable radio and television system operators (hereinafter as “system operator”) provide no service within such areas.
  3. The subsidies in these essential directions shall be paid in the budget item of this  Fund.
  4. Each subsidy item in each area where service has not yet reached shall be limited to the construction expenses in the following subparagraphs:

    (1)Relevant materials and facilities of main fiber network;

    (2)Relevant materials and facilities of microwave system; and

    (3)Relevant facilities in satellite hub telecommunication equipment room.

The subsidy amount in preceding paragraph shall not exceed 50 percent of the total construction expenses of the subsidized construction plan, and is limited to NT$ 6,000,000.

The subsidized construction plan in the preceding paragraph shall include all main fiber networks, satellite signal reception facilities, microwave system and user-end coaxial cable networks to be built.

If the fiber constructions in isolated lands or remote area would not be built or be built with huge cost, therefore the satellite hub telecommunication equipment room should be built instead, the concrete reasons shall be attached; the subsidized amount is limited to the satellite signal receivers and modulators.

The total construction expenses and subsidy amount of the subsidized construction plan in paragraph 2 shall be approved by NCC.

  1. The subsidy amount in each system operator’s subsidized maintenance plan shall be the losses incurred in the year due to providing cable television service in the remote areas.

The remote areas shall refer to the township (town, city) is with a population density no more than one-fifth of the average national population density, or isolated lands at least 7.5 km away from the location of local governments of special municipalities or counties/cities.

The subsidy amount in subsidized maintenance plan in paragraph 1 shall be the losses incurred in the year due to providing cable television service in the remote areas and is limited to NT$ 1,2000,000.

The subsidy amount to the losses in subsidized maintenance plan incurred in the year shall be approved by NCC.

  1. The system operator may apply for subsidy from NCC according to the paragraph 3 of Point 4, within the announced deadline by NCC, attaching application form, subsidized construction plan, and other documents indicated by NCC, and serve duplicate copy to the local governments of special municipalities or counties/cities. Applications beyond the deadline shall be dismissed.

The applicant shall be noticed to amend the documents in the preceding paragraph within the limited time if the documents are insufficient. If the documents are still insufficient after amendment or not to be amended beyond the limited time, the application shall be dismissed.

The application form shall contain the following items:

(1)The name of application and the legal representative, and shall be signed and sealed;

(2)The name of subsidized construction plan;

(3)The reasons of application; and

(4)The urgency of the application.

The subsidized construction plan shall contain the following items:

(1)Name of the subsidized construction plan;

(2)Goals of the subsidized construction plan;

(3)The area (square km2 , villages / communities) to be served and the population within;

(4)Schedule of construction;

(5)Construction circuit diagrams: including main fiber networks, satellite hub reception networks or microwave system, and user-end coaxial cable networks;

(6)Description on construction methods and facilities;

(7)Total construction expenses and analysis on each cost item;

(8)Efficiency evaluation; and

(9)If the satellite hub reception networks shall built, the necessity shall be described and efficiency of it shall be compared and analyzed with the one of fiber networks.

  1. The system operator may apply for subsidy from NCC according to the paragraph 1 of Point 5, within the announced deadline by NCC, attaching application form, subsidized maintenance plan, and other documents indicated by NCC, and serve duplicate copy to the local governments of special municipalities or counties/cities. Applications beyond the deadline shall be dismissed.

The applicant shall be noticed to amend the documents in the preceding paragraph within the limited time if the documents are insufficient. If the documents are still insufficient after amendment or not to be amended beyond the limited time, the application shall be dismissed.

The application form shall contain the following items:

(1)The name of application and the legal representative, and shall be signed and sealed; and

(2)The name of subsidized maintenance plan.

The subsidized construction plan shall contain the following items:

(1)Name of the subsidized maintenance plan;

(2)Goals of the subsidized construction plan;

(3)The area (square km2, villages / communities) to be served and the population within;

(4)The length of existing fiber cable networks and coaxial cable networks;

(5)The annual revenues, annual maintenance and operation cost and annual losses of cable television service compiled according to the “Accounting procedure manual of relevant maintenance expenses in promoting cable television universal service in remote areas” (as appendix 2); and,

(6)Detailed information of annual operating losses reports certified by a CPA.

  1. While NCC reviews the subsidized construction plans, NCC may invite scholars, experts to provide concrete counseling opinions on the urgency, efficiency, feasibility, accuracy of the total construction expenses and every cost item and other relevant factors.

The subsidized area with the households below 60 households per square kilometer, and households scatter within the area, shall be subsidized in fist priority.

  1. The system operator with approved subsidized construction plan shall conclude administrative contracts with NCC within 2 weeks after notice of NCC.

The subsidized system operators shall execute faithfully according to the administrative contract in preceding paragraph and the subsidized construction plan approved by NCC, and apply for inspection of NCC with the construction accomplishment report after construction. If the construction fails to pass the inspection, shall be handled according to the administrative contract in preceding paragraph.

The inspection may be carried out by NCC with the local government of special municipalities or counties/cities.

If there is any change in the approved subsidized construction plan, the system operator shall apply for approval with NCC of such change at least 1 month prior to the deadline of construction. If such change is extension of the construction period, such extension shall not exceed 2 month and is limited to once only.

  1. System operator with approved subsidized maintenance plan shall apply for subsidy amount from NCC attaching uniform invoices within 2 weeks after notice of NCC; failure to applying for subsidy amount within the deadline will be deem giving up the subsidy.

The audit tasks to the maintenance expenses in the plan in preceding paragraph may be carried out by NCC with the local government of special municipalities or counties/cities.
