Draft of Regulations Governing the Establishment and Use of Dedicated Telecommunications Networks passed by NCC中文

With view to aligning with the Telecommunications Management Act (hereinafter referred to as the Act), promulgated on June 26, 2019, the draft of Regulations Governing the Establishment and Use of Dedicated Telecommunications Networks was passed by the National Communications Commission (NCC) today (the 15th) during the 905th Commission Meeting. The passing of the draft enables NCC to seek feedback from all stakeholders as the next step.

According to Paragraph 7 of Article 50 of the Act, this draft regulates only the telecommunications network that is established with radio frequency allocated by the competent authority and is used only by the telecommunications network operator itself. Therefore, upon the promulgation of the Act, the existing dedicated telecommunications network will no longer be managed thereby.

Moreover, the dedicated telecommunications network has been divided into the public service network and the private network so as to facilitate development of innovative applications and greater flexibility. The public service network refers to telecommunications networks dedicated to the following jurisdictions and public services: police, firefighting, disaster-prevention, medical, coast patrol, rescue, railways, highways, MRT, airport ground crew, fisheries, water conservancy, weather, academy (education), judiciary, correctional institutions, foreign affairs, ports (harbor) affairs, forestry, taxation, immigration, electricity, water, gas and other public services. The private network, on the other hand, refers to non-public services network established for private use and the applicant thereof is limited only to companies, legal persons and organizations.

Telecommunications networks dedicated to vessels, aircrafts, taxis and wireless experiments and R&D purposes do not fall under the management scope of this draft; other administrative regulations shall be established respectively. In addition, the draft is not applicable to the decision of the Executive Yuan on December 5, 2019 to release 4.8-4.9GHz to dedicated telecommunications networks to companies between 2020 and 2021; likewise, separate administrative regulations shall be established by NCC to manage these.  

The draft shall be announced to the public in advance for 30 days and the public meeting shall be held to seek valuable feedback. By doing so, NCC hopes that all sectors can become aware of the proposed changes so that the draft version of the regulations can be perfected.
