In order to enhance the protection of individuals’ personal data and in coordination with the National Development Council (NDC), the National Communications Commission (NCC) gained membership to the Global Cooperation Arrangement for Privacy Enforcement (Global CAPE), along with various other domestic Privacy Enforcement Authorities (PEAs), namely the Ministry of the Interior, the Ministry of Foreign Affairs, the Ministry of Education, the Ministry of Justice, the Ministry of Economic Affairs, the Ministry of Transportation and Communications, the Ministry of Labor, the Ministry of Agriculture, the Ministry of Health and Welfare, the Ministry of Culture, the Ministry of Digital Affairs, the National Science and Technology Council, the Financial Supervisory Commission, the Public Construction Commission, Executive Yuan and the Fair Trade Commission.
Notice of the verification and approval of the application was received from the administrator of the Global CAPE—The Ministry of Economy, Trade and Industry of Japan in March 2024. Consequently, NCC, as well as the aforementioned authorities, can expect enhanced cross-border cooperation with international partners in the enforcement of data protection and privacy laws, ultimately offering greater protection of the personal data of people in Taiwan.
The Global Cross-Border Privacy Rules (CBPR) Forum endeavors to promote trusted data flows and eliminate unnecessary barriers in digital trade. As the global trend of digitalization continues to accelerate, demand for cross-border data transmission has increased sharply. Incidents that infringe personal data often involve cross-border factors, requiring mutual assistance and cooperation between jurisdictions to effectively combat illegal activities and prevent the infringements becoming any worse. For this reason, the Global CBPR Forum established the Global CAPE in October, 2023 and invited PEAs not limited to those of Forum members, to facilitate cooperation on enforcement jurisdiction and policies among each Participant.
In addition to Chinese Taipei, several other jurisdictions, including the United States, Japan, Canada, the United Kingdom, South Korea, the Philippines, Singapore, Mexico, Dubai International Financial Center, and Bermuda, have also joined Global CAPE. This opens up opportunities for Taiwan's PEAs to collaborate with international partners on cross-border enforcement related to privacy complaints, data protection, data sharing, and professional exchanges. Such collaboration is expected to enhance the protection of information privacy and align with international legal standards, fostering cross-border digital trade and boosting Taiwan's digital economy.
